These Terms & Conditions govern your use of the Ochre Fire Design website and services. By using this website, you agree to comply with and be bound by the following terms.
Ochre Fire Design provides fire alarm design, CAD drawing services and consultancy to installers, integrators and consultants.
All services are subject to agreement of scope, timelines and fees prior to commencement.
It is the Customer’s responsibility to ensure that all material presented for processing is free from any third party claim of copyright.
In the event that any material is accepted by us without a certificate of copyright or owner’s consent, the Customer shall nonetheless be deemed
by requesting us to process such material to be certifying that there is no third party claim to copyright therein.
Should it arise that changes are required to any drawing previously produced by the Company for a third party, the Customer will be required to
submit AutoCAD or original PDF files to the Company for completion of said changes. Subsequently, by submitting these files, paragraph 2.2
then applies.
For clarity, any drawing previously completed by the Company is held electronically in our secure archives. Under no circumstances will these
electronic files be released to anyone other than the Customer who requested the initial drawings and it will be deemed that once payment is
made these files are the property of the initial Customer. Releasing or amending these drawings for a 3rd party will only be completed on receipt
of the files in paragraph 2.3 or with written confirmation from the initial Customer to the Company.
The Customer agrees to pay such charges of the Company as shall be notified to and agreed with the Customer.
Unless otherwise agreed, any grant of credit facilities is made on the condition that payment is made within 30 days. The charges are invoiced
to the Customer on completion of the works. The Company reserves the right to charge interest on any overdue amounts at the rate of 2% above
the base rate from time to time of the Bank of England from the due date until the date of payment.
Where payment is not made within 30 days, all costs incurred by the company in recovering the debt will be added to the amount due by the
Customer.
Where payment is made by cheque, the company shall not be deemed to have received payment until the payment has cleared.
Fixed price zone plan & layout costs are calculated based on the number of zones & devices, which should be in accordance with the recommendations of BS 5839-
1:2025. The company reserves the right to withdraw the offer for projects not zoned in accordance with BS 5839-1:2025. If additional devices or zones are required, we reserve the right to re price the work.
The company shall carry out work under written instruction from the customers employees, including but not limited to email and postal
instructions. Should a purchase order number or reference be required on the invoice to meet the customers own company procedures, it is the
responsibility of the customer to provide this prior to invoicing. The absence of a purchase order number or reference does not indemnify the
customer from any charges due.
Additional zone plans for multiple CIE’s on the same fire alarm system can be created electronically for an additional charge and treated as an additional zone plan (charged at the appropriate rates).
All goods will remain the property of the company until the price has been paid in full and the customer shall remain a bailee only until payment
is made.
You agree to use this website for lawful purposes only and in a way that does not infringe the rights of, or restrict the use of, this website by any third party.
All content on this website, including text, graphics and design, is the property of Ochre Fire Design unless otherwise stated. You may not reproduce, distribute or use any content without prior written permission.
All projects are returned in portable document format (PDF) and also AutoCAD (DWG) formats on request. The design of the common template,
including all graphics, colours, icons, AutoCAD layer configuration, AutoCAD blocks, AutoCAD template files remains the intellectual property of
the Company.
The company grants the customer the sole right to use the electronic files emailed to the customer to make further changes or additions to the
files and to print and to display the changed files.
The company expressly does not grant the customer the right to discharge these rights in 6.2 to any 3rd party for completion of further projects
for any other party other than the customer.
While we aim to ensure all information on this website is accurate and up to date, Ochre Fire Design makes no guarantees regarding completeness or accuracy.
Ochre Fire Design shall not be liable for any direct, indirect or consequential loss arising from the use of this website or reliance on its content.
All project-specific liabilities will be outlined within individual service agreements.
No liability will be accepted by the company for failure to meet delivery dates and/or deadlines, however caused.
No liability will be accepted by the company for the cost of any errors made by either party due to
misinterpretation of information submitted by the customer or approved for digital export or printing by the customer.
No liability will be accepted by the company for the cost of any additional fire alarm devices or associated equipment or cost of any remedial
works for any fire alarm system installation or modification from a fire alarm system design carried out by the company. It is the responsibility of
the customer to review any such fire alarm system design completed remotely from plans only on receipt to confirm its suitability and compliance
for the intended premises
